Terms and Conditions

These terms apply to the game Petey Feather Quest ("the game") made by Nodiver d.o.o., Cesta Zore Perello-Godina 2, 6000 Koper, Slovenia ("we", "us"). By installing or playing the game you agree to these terms. If you do not agree, please do not use the game. The terms of the store you downloaded the game from (Google Play or the Apple App Store) also apply.

1. Licence

We give you a personal, non exclusive, non transferable licence to install and play the game on devices you own or control, for your own non commercial entertainment. You may not copy, sell, rent, modify, decompile or reverse engineer the game, or use cheats, bots or modified versions, except where the law expressly allows it.

2. Free game, full game and purchases

The first levels can be played for free. The full game and packs of gold can be bought inside the game. All payments are processed by Google Play or the Apple App Store, and their payment and refund rules apply. Prices are shown in the store before you buy.

3. Gold and other virtual items

Gold, coins, candies, costumes, skills and boosts are virtual items that only work inside the game. They have no money value, cannot be exchanged for real money and cannot be transferred to another player. Gold is stored on your device, so it is lost if you delete the game or its data. We may change how virtual items work to keep the game balanced and fun.

4. Right of withdrawal

If you are a consumer in the European Union, you normally have 14 days to withdraw from an online purchase. For digital content such as the full game and gold, which is delivered right away, you agree when buying that delivery starts immediately and you acknowledge that you therefore lose the right of withdrawal once the item is delivered. This does not affect your rights if an item does not work as described. For refunds please contact the store first, or contact us.

5. Ads

The free version shows ads, and rewarded videos can be watched by choice for a bonus. A rewarded bonus is only given when the ad network reports that the video was watched. Ads are provided by third parties and we are not responsible for their content, but please tell us if you see an ad that is not suitable.

6. Leaderboard, nicknames and ghosts

When you finish a level, your nickname, result and a recording of your run (a ghost) are shared on the world leaderboard where other players can see, race and watch them. Please choose a friendly nickname. Do not use your real full name, offensive words or other people's names or brands. We may remove nicknames, results or ghosts that break these rules or that look like cheating, without notice.

7. Fair play

Do not try to cheat, send fake results, attack or overload our server, or disturb other players. We may block results from devices that do so.

8. Intellectual property

The game, including its characters, artwork, music, sounds, levels and code, belongs to Nodiver d.o.o. or its licensors and is protected by copyright and other laws. All rights not expressly given to you are reserved.

9. Updates and availability

We may update the game, add or change content, or end online features such as the leaderboard and ghosts. We try to keep the game running smoothly but cannot promise that it will always be available or free of errors.

10. Liability

The game is provided as it is. To the extent the law allows, we are not liable for indirect damage, lost progress or lost virtual items. Nothing in these terms limits liability that cannot be limited by law or your statutory rights as a consumer.

11. Children

The game is made for players of all ages. Children should ask a parent or guardian before buying anything in the game. Parents can manage purchases with the family and parental controls of Google Play or the App Store.

12. Privacy

How we handle data is explained in our Privacy Policy.

13. Changes to these terms

We may change these terms. The new version is published on this page with a new date. If you keep playing after a change, the new terms apply.

14. Law and disputes

These terms are governed by the law of the Republic of Slovenia. Courts in Koper, Slovenia have jurisdiction, but consumers can always also use the courts and the mandatory consumer protection laws of their own country. EU consumers can also use the EU online dispute resolution platform.
